Imprint obligation for E-Label wine labels

After repeated consultations with lawyers, it is probably advisable to display an imprint on the digital wine labels.

First of all, we assumed that an e-label for wine is not a real website, as it has no navigation and cannot be accessed without the QR code. The EU Regulation 2021/2117 is rather vague about this and does not address this issue. 

Our legislation in Germany requires an imprint in accordance with § 5 of the German Telemedia Act (TMG) and § 18 of the State Media Treaty (MStV). 

We have spoken to lawyers several times and their clear recommendation (as of 01.10.2023) is that there must be an imprint. 

Therefore, we at E-Label have made it possible to enter the imprint data in accordance with the above-mentioned laws.
